Snowbird Tax Problems: Florida Residency and the IRS

Splitting time between Florida and another state creates tax complications most snowbirds do not see coming.

Thousands of snowbirds split their time between Florida and a northern state — New York, New Jersey, Connecticut, Massachusetts, Michigan. They come to Sarasota for the winter, head north for the summer, and assume that claiming Florida residency means they don't owe state income tax up north.

It's not that simple. Your former state may challenge your Florida domicile claim. New York is particularly aggressive — the Department of Taxation conducts "domicile audits" that examine where you spend your days, where your doctors and dentists are, where you vote, where your driver's license is from, and dozens of other factors.

IRS Complications

Domicile disputes with state tax authorities can trigger federal complications. If a state audit results in additional state tax liability, it may also trigger federal adjustments. And if you've been claiming tax benefits based on Florida residency — like deducting state taxes paid to a northern state while claiming Florida domicile — the IRS may take interest.

If you're a snowbird with tax complications, let's talk. These issues are resolvable, but they require someone who understands both federal and multi-state tax law.
